1 - Gênesis 31.38

Se alguns homens pelejarem, e um ferir uma mulher grávida, e for causa de que aborte, porém não havendo outro dano, certamente será multado, conforme o que lhe impuser o marido da mulher, e julgarem os juízes. (23) Mas se houver morte, então dará vida por vida.
3 - Êxodo 23.26

Comentário: Sem dúvida, o texto de Êxodo 21:22 é o mais díficil de interpretação. Dois homens pelejando; um deles fere a mulher do outro, grávida. Se ela abortar, ele paga uma multa. Se ela morrer, o agressor pagará com a própria vida. Eu vejo duas duas alternativas para interpretar o primeiro fato. A agressão à mulher com relação ao feto pode ter sido culposa ou dolosa ,segundo o linguajar jurídico. Se o agressor propositalmente atinge a barriga da gestante com a intenção de matar é um crime doloso. Há muitos relatos em nossa época de homens chutando ventres de grávidas. Neste ato há uma nítida inteção de matar o feto. Se o agressor em peleja com outro homem atingir sem intenção a mulher dele, e esta abortar o crime é doloso.
Interpretando literalmente o que está no texto desta versão, para ambos os casos envolvendo a morte do feto a pena será uma multa. Todavia, caso a mulher morra por ferimento de ato culposo ou doloso, não importa: a sentença é a morte.
Deus deu a minha esposa e a mim duas lindas filhas. Venho de uma família onde este ato não é aceito. Quanto a mim, não aceito a possibilidade do aborto a não ser em caso de estupro por bandido ou incesto por abuso de pai. Quero concluir, dizendo que não tenho a sabedoria necessária para interpretar a razão da multa ordenada por Deus no v.22, pela morte do feto não importando se por culpa ou dolo.

Comment: Without doubt, the text of Exodus 21:22 is the most difficult of interpretation. Two men fought, one hurts the other's wife, pregnant. If he quit, he pays a fine. If she dies, the offender will pay with their lives. I see two alternatives for interpreting the two first fact. The assault on women in relation to the fetus may have been negligent or fraudulent, according to the legal language. If the offender intentionally hits the belly of the pregnant woman with intent to kill is a felony. There are many reports of men in our time kicking the bellies of pregnant women. In this act there is a clear Intent to kill the fetus. If the attacker in battle with another man with no intention to reach his wife, and that abortion is criminal intent.
Interpreting literally what is in the text of this version, for both cases involving the death of the fetus to be a penalty fine. However, if a woman dies from injuries from negligent or wrongful act, no matter: the sentence is death.
God gave me my wife and two beautiful daughters. I come from a family where this act is not accepted. As for me, I do not accept the possibility of abortion except in cases of rape or incest villain for abusing father.
